Regarding the enforcement of the obligation to pay wages
According to amendments to the Federal Law, the state labour inspector may now independently decide on the enforcement of the employer's obligation to pay wages to the employee.
Such a decision is made in the event of the employer's failure to comply with an instruction from the State labour inspector to remedy a violation of labour law relating to the payment of wages and/or other payments to the employee.
Within 3 working days of the adoption of the decision, the decision is sent by the State labour inspector by registered mail with notification of delivery or in the form of an electronic document signed by a qualified electronic signature to the employer.
In turn, the employer has the right to appeal against the decision within 10 days of receipt of the letter in court.
If the decision on enforcement is not undertaken by the employer and the deadline for appealing against it has expired, a copy of the decision shall be sent to The Federal Bailiff Service.
